Police State Example Served Up Locally


This is an update to the following post: Is The U.S. Really A Police State?

Since the 9/11/2001 incident after George W. Bush took control of the United States government this country has sunk deeper into a lawless state of anarchy. The Ruling Elite, a small group of wealthy individuals and corporations encompassing all relevant political parties, has literally trashed the U.S. Constitution. That universal Law is only as good as the people make it. Unfortunately, they've decided the Rule of Man is more to their liking and subsequently have co-opted, corrupted and perverted the Law and the Courts with their arrogant, self-serving lawlessness. Glenn Greewald has a timely article today: Guantanamo death highlights U.S. detention policy - You may think that what happens to a few "rag-head" Arabs that supposedly hate our guts has nothing to do with you or your family and the long-held belief that our home is our castle and we are always safe there, you may want to re-think your beliefs.

Thursday's February 3, 2011, Times-Standard has an extremely revealing expose by Jeffrey Schwartz in the My Word: Up in arms: Search warrant folly. You may think the we are people with certain, guaranteed rights with honorable, decent and just men stationed in high offices to protect those rights. Armed to the teeth, masked gunmen can't just cave your door in sometime in the early morning, shouting police, drag you and your family out of bed, providing you didn't do something stupid, like trying to defend yourself and your family in your own home, on your own property, and get shot dead, or can they. Mr. Schwartz says they not only can, but do on a regular basis right here in Humboldt County.

Today we see people living in the more brutal, domineering totalitarian police states beginning to stand up for their personal and collective rights as equal human beings - both men and women. What's becoming more and more widespread in this country has been going on in these other countries for decades. All with American blessings. Considering the fact that Mr. Schwartz had the courage to write that article, making us all aware of what's going on in our names, tells me we won't wait decades to put a stop to this lawless corruption.

What puts everyone's life, liberty and citizenship in jeopardy is who Mr. Schwartz says is responsible for this, what I consider criminal conduct and perversion of the law, the gutless and sycophantic District Attorney and Superior Court Judges. They legitimize this outlandish police action, what amounts to a pure, raw act of terrorism, without any apparent substantive evidence of probable cause other than someone's unproven accusation. This situation puts everyone under the gun and at risk.

What is to stop anyone, an irate neighbor, a family member or anyone else from calling the police and telling them some wild, unsubstantiated lie about you? Mr. Schwartz says:
But if you own a handgun or rifle, just imagine this: A judge issued a warrant to search your house because someone you know saw you with it and they don't know whether or not you have a license to own it.
Sadly, Jeffrey Schwartz doesn't offer much hope for all of the common, law-abiding people that live in this county, other than to say:
"It remains to be seen if it is OK with the higher courts and juries in civil rights actions against law enforcement officers." [Emphasis added]
 "Higher courts." Our history tells us where that goes. Courts (Judges) protect themselves in these kinds of situation involving police power. And "juries in civil rights actions against law enforcement officer"? The problem is NOT with the "law enforcement officers." It is with the District Attorney and the Superior Court Judges.

Humboldt Elite's Royal Baby



Great news! Read all about it. A royal baby was born! 

Two days into the new year and we're blessed with a new female Superior Court Judge by the name of Joyce D. Hinrichs. Anyone know who this woman is or what makes her qualified? By any chance, is she from a local family with roots in Humboldt County? What makes her of "royal blood" anyway?

Joe's objective interests in politics and elections are purely spectatorial. When you consider how rare it is to get a new Superior Court Judge, well that's something Joe considers really important. While these judges are elected and apparently re-elected, the history of their tenure is that they damned near die ensconced in their little kingdoms. Unfortunately, he never saw anything in or on the "media" talking about electing a new judge. Some people knew there was an election, the newspaper says the courtroom was overflowing. 

She says, "I am really honored to be joining the sitting judges here on the Humboldt County Superior Court. They are wonderful, dedicated, hard-working judges and its an on honor to sit among them." Is this what we can expect from her, gushy, but dedicated, hard work? Whatever that means!

When you consider the impact judges have on the day to day lives of everyone, you would think that the serious voter, those people that care about their homes, businesses, property and persons would make sure they know exactly what they are getting. Well, you would think so, but then the whole country just elected a new President and they don't have clue about him.

Jungle Law Rules Supreme In Eurekaville

Democracy, as an instrument of government, is worthless when people become the law, and that, without any accountability. The Law of the Jungle becomes the defacto government. Those that rule are those with the POWER. Read for yourself who has the power in Humboldt County.

Judge throws out involuntary manslaughter case

Everyone that sees "DISMISSED" knows in his or her heart that Humboldt County Superior Court Judge John Feeney legally granted every police officer in Humboldt County the licence to kill with impunity.

When "Feeney began Tuesday's hearing by saying he believed the grand jury indicted without sufficient probable cause to establish that the defendants had committed an illegal act or a lawful act in a criminally negligent manner" he superimposed his judgments over the findings of the people. He made the Grand Jury system a mockery. He also put this community on notice, you are all on your own when you can be gunned down on a mere "belief."

The most disgusting and disingenuous statement observed to date that defines the "police" attitude justifying this whole tragedy was a quote by "William Rapoport, who was representing Zanotti in the matter. '(This case has) destroyed a huge part of these men's lives for the last nine months, and it's time they go some relief. ... They've had a cloud hanging over their heads for no good reason other than someone's political aspirations.'" The report goes on to say: "Douglas and Zanotti were not immediately available for comment." I would guess not!

Not when this clown, Rapoport can dismiss life and law with such casual and calloused disregard.

ADDENDUM: Wednesday, August 27, 2008 :: Comments in The Eureka Reporter as reported by Karen Wilkinson. Note: "Attorney William Bragg, who along with William Rapaport and Greg Rael, represented Douglas and Zanotti, said he expected the dismissal, adding the case shouldn’t have been one in the first place. He cited overwhelming case evidence on the defense’s side and said Feeney made the decision based on the law." HOWEVER, Mr Greenson for The Times Standard quotes the Judge to say, "The court's sympathies are extended to the friends and family of Ms. Moore for her tragic death, but the court cannot find evidence of any criminal conduct by Chief Douglas or Lt. Zanotti." The Judge didn't quote "law." He acted on his opinion. Judges are NOT the law.

Karen Wilkenson continues: "The defense attorneys filed motions starting in June seeking to have the case dismissed. The motions stated Gallegos misrepresented the law to the grand jury and didn’t provide evidence that would have helped justify the men’s decisions in the standoff." Joe contends that if Mr. Gallegos "misrepresented the law to the grand jury and didn’t provide evidence" he did so deliberately; he's hardly that stupid, incompetent or politically motivated.

His concluding statement in The Eureka Reporter indicates that he has his priorities or legal responsibilities a bit sqewed. Note: "While he understands the support the former EPD leaders received from others in law enforcement, Gallegos said there’s also an obligation to Moore’s family. He hopes the judicial determination will bring closure to her family, the community and those involved." If his sworn Oath of Office means anything, his first priority is to the Law and then to the community. While it is a tragedy for the Moore family it is a bigger tragedy for the community. No "judicial determination" in and of itself "brings closure." JUSTICE brings closure!

Guilty As Accused

Ever hear the expression, "A picture is worth a thousand words"? How about two pictures worth a million words?


Is Diane Batley responsible for plastering this guy's guilty mug all over the Eurek Reporter's front page as one of her first duties?

If so, good job. We wouldn't want to take a chance that any prospective juror that sees this picture could find this guy anything but guilty now would we? Otherwise, why is he presented before the public and prospective jurors in a prison-guilty monkey-suit all shakled up like some raving lunatic ready for his tar and feathering? He's guilty! End of story.

End of his story, but not that of Ms. Batley or The Eureka Reporter. I'm sure they will provide much grist for the mill.


ADDENDUM Wednesday, August 13, 2008: Innocent Until Proven Guilty.

This is the front page picture in the Time-Standard, "Gundersen's wife held for her safety, ..."

No monkey suit and chains here. Is that because the jury's already been selected?
