Police Violence and Violence Against the Police

On March 31, 2004, one year after the launch of the U.S. war against Iraq, four U.S. military contractors, mercenaries, were ambushed and killed in the Iraqi city of Fallujah and their charred corpses were hung from a bridge. The indignation expressed by the American political leadership and senior military officials was that their imperial privilege had been challenged— how dare the people whose country they had illegally invaded and substantially destroyed and whose relatives, neighbors and friends they had murdered fight back? The city of Fallujah was surrounded; women and small children were told to leave and then the slaughter began. White phosphorus and depleted uranium shells were dropped until thousands, possibly tens of thousands, of Iraqi boys and men in Fallujah had been murdered.

Left unsaid at the time was that most Americans subjected to an illegal war, invasion and occupation would respond largely as the citizens of Fallujah had done. Self-defense against invading hordes is as close to a natural right as the term could convey. The real crimes committed in / on Iraq were the war and occupation launched by the Americans and Brits. And the collective punishment visited upon the male citizens of Fallujah very closely resembled the acts that led to collective punishment being designated a war crime in the first place— the group slaughters regularly meted out by the Nazis in WWII for acts committed by unrelated individuals or groups. Today the Americans and Israelis (against Palestinians) are the main global keepers of the war crime tradition of collective punishment.

Former New York City Mayor Michael Bloomberg made explicit the military role of the police when he bragged that he had ‘the seventh biggest army in the world,’ the NYPD. Mr. Bloomberg claimed the NYPD to be ‘his’ army in 2011 as he was violently repressing the Occupy Wall Street movement. A short time after the comments were made the NYPD participated in a coordinated national assault against lawfully assembled protestors that included the total destruction of the Occupy library, kitchen and associated infrastructure. Through an ongoing campaign of violence, infiltration, disinformation, ‘pre-emptive’ kidnappings and legally dubious arrests the Occupy movement was effectively destroyed. Mr. Bloomberg made his fortune from Wall Street and he used ‘his’ army to prevent it from being held legally and socially accountable for its crimes.

When Ismaaiyl Brinsley murdered NYPD officers Wenjian Liu and Rafael Ramos in self-proclaimed revenge killings for the murders of Mike Brown and Eric Garner spokespersons for the NYPD and the PBA (Police Benevolent Association) were quick to personalize the victims while using the language of belligerent militarism to politicize the broader context of growing public resistance to police violence. What wasn’t expressed by NYPD spokespersons was any regret for the unjustifiable murder of Eric Garner or any number of other black and brown youth, for participation in systematic racial repression like stop-question-and-frisk or for the acting as an occupying army in poor neighborhoods of color. What was affirmed through the words of spokespersons for the police was that black lives don’t matter but that cop lives do.

The allegation against Mr. Garner was that he was selling ‘loosey’ cigarettes, individual cigarettes on which applicable taxes were not paid. In the run-up to the Great Recession Wall Street made dubious, in many cases fraudulent, mortgage loans of over one-trillion dollars. The economic calamity that resulted cost millions of families their homes and millions more their jobs and life savings. The everyday business of U.S. corporations is avoiding hundreds of billions per year in tax liabilities through sham transactions. Eric Garner could in theory have sold loosey cigarettes for the next 500,000 years and not neared the annual tax avoidance of Apple Computer or General Electric had the police not murdered him. The loss of any life through violence is tragic, which makes the police practice of casual, consequence-free, assault, murder and harassment so worthy of public condemnation. The contention put forward by PBA spokesperson Patrick Lynch that those protesting police violence have ‘blood on their hands’ leaves unaddressed the reasons why protestors are protesting— around the country heavily armed, militarized police routinely assault and murder people, largely black and brown youth, with impunity and largely without conscience. Seventy-six unarmed black and brown youth have been murdered by the police since 1999 and it is only the murder of two cops that raises the moral outrage of the police. And here lies irony— the protestors by-and-large have great sympathy for the families of the slain cops whereas, as best can be determined by the words and actions of the police, courts and political leadership, the imperial privilege of police to murder with impunity remains intact.

Picture (3) above: it has been nearly fifteen years since unarmed Amadou Diallo was murdered by the NYPD in a hail of bullets. In the intervening years the police across the country have murdered seventy-six unarmed people of color (link above), have been increasingly militarized, given the right to rob people of their possessions at will, made immune from prosecution for crimes committed and dedicated to systematic race-based repression like stop-and-frisk. The failure of the political leadership and the judiciary to hold the police accountable at any level demonstrates the political role that the police fill— that of an army of the rich existing to protect the ruling class from social accountability. The existence of a heavily armed, highly militarized, wholly unaccountable army to protect a class and race based social order is totalitarian by degree— those on the side being repressed bear the brunt leaving the illusion of justice for those not paying attention. The one-sided response of the political leadership and police spokespersons to the tragic murder of Wenjian Liu and Rafael Ramos is evidence of the social order being protected. Left entirely unaddressed is the historical role of the police in maintaining an unjust race and class based social order from slave patrols to convict leasing to mass incarceration and for-profit prisons to class and race-based enforcement of selectively repressive laws. And to be clear, it is the political leadership that has designated and so-armed the police to be the quasi-military force they now are.

The mainstream press is claiming that the murders of Messrs. Liu and Ramos have reframed the protests against police violence to be against violence. Without disarming the police and changing their role from militarized guardians of ruling class interests to servants of all of the public it is difficult to see how opposing violence without opposing the existing role of the police is politically coherent? And reduction of the idea of justice to the will of the police is to accept the role they have been given in protecting class and race interests by a political leadership that straightforwardly answers to economic interests. Put differently, if fealty to the law had anything to do with the current role of the police then areas with high levels of criminal activity could be found in the financial towers of lower Manhattan and on Park and Madison Avenues just north of Forty-Second Street. As of a few days ago the NYPD was nowhere to be found enforcing the law in these locations.

Hallelujah! Finally Someone With GUTS

In this Sunday morning, December 7, 2014, edition of the Times-Standard newspaper, right on the second page I was greeted with this picture and caption:
"Recent police killings are described and protested at a rally in Old Town Eureka's Gazebo Square during Arts Alive! on Saturday night. About 50 members of a new, unnamed collectie gathered to lay on the  ground with targets on them as if dead, talk about  how people of color still face discrimination  and  read  the names and stories of those  recently killed -- including Eureka's Thomas McClain."
At least I am not the only one in this town incensed at the murder of an innocent boy by Eureka police willing to take stand and do something. (I don't consider what goes on over at the Tuluwaa Crier anything more than a pretence; watered down double-speak.) Ever since the murder and particularly since the District Attorney Paul Gallegos decided to cover over the obvious crime with his decision of impunity, I've waited for a newspaper editorial, a letter to the editor, something from the newspaper's moral standard bearers, the Reverend Eric Duff, Sherae O'Shaughnessy or Tim Martin - Just Nothing!

The biggest tragedy for the social order in Eureka in my book are the religious people's abject silence. No moral outrage from the preacher, priests or pastors. Do they not know that their silence is an act that affirms and condones the morally corrupt lawless acts of these criminals? And destroys the social order?

I guess these 50 people can assuage their consciences by believing they are really accomplishing something beneficial that will lead to meaningful, substantive change. I got to hand it to them, laying down in the Gazebo with targets on their chest is really meaningful. The people in this town that are responsible for a rogue police department and a lawless District Attorney are really going to pay attention, see and hear them. When these 50 can figure out how to turn their die-in stunt into meaningful, substantive and effective non-cooperation, that actually holds the people's feet that are responsible to the fire, maybe then someone will actually see, hear and acknowledge them.

Law is only as valuable as the people that honor, comply and enforce it. Without Law there is and cannot be justice - only anarchy and chaos. The police become a  law unto themselves, the justice system, District Attorney, lawyers, juries and judges are without equanimity, totally corrupt. People and children of all color are murdered at will for nothing more than an accusation, or a psychotic hallucination someone believes to be real. Life's whole experience in Eureka becomes a living nightmare.

The near total lack of interest, moral indignation, and lawfully motivate outrage is a clear indication of how deep the sickness runs in Eureka and Humboldt County.

The Diseased Face of Impunity

While these people celebrate, the city of Eureka dies. For Police Chief Andrew Mills to promote Brian Stephens to Captain in full justification of his blatant statement to this community that "early findings of the investigation revealed McClain had reached for a replica handgun in his waistband and Linfoot was justified in firing his weapon" is as foul an obscenity as there ever was. All I can say, is every citizen of Eureka will be sorry for the day they ever heard of Andrew Mills.

Welcome to Mexico. Your life isn't worth a pinch of rat shit.

If this murder stands, justified, then there is absolutely nothing stopping the Eureka Police from doing anything they want any time they want. What's next for the EPD? Death squads?

Tommy McClain did NOTHING to threaten anyone. The ONLY threat that existed was in the scared crapless, paranoid men's sick minds that brought pointless violence to Tommy McClain's home. The really corrupt sick bastards in this community are the people like Andrew Mills that justify and support such sickness, lawlessness and paranoia.

You wanted them Eureka, just like this country, the old voters anyway, wanted conservative Republicans running congress, well now you can just live with the consequences. When the District Attorney agrees with Chief Mills your deal with the Devil, everyone that voted, is sealed.

MANDATE - In A Pig's Eye

The Republicans in this country believe the November 4th election gave them a mandate to rule this country and take out the gutless criminal Barack Obama, or at least finish delegitimizing his presidency. What the blowhard Republicans should do is sit down, collect their pay, shutup and go home. The majority non-vote delegitimizes the election - there is no mandate. One third of legal voters do not possess the legal right to rule over two thirds of the majority and more than 0.01 percent of the richest do.

The Non-Cooperating, Non-Voter has spoken.

This System, the American System of Governance from Federal to local, for all intents and purposes, is defunct. Where a government derives its power and authority from the people, this government is impotent, bankrupt. As are the laws enacted. Clearly, where legitimacy for any election in a democracy requires a quorum, the election failed miserably. So, now what.

The Times Standard newspaper had an editorial and and article on this:
1. Voter turnout mediocre in Humboldt County, poor statewide

2. Editorial: Voter turnout leaves much to be desired
"If turnout were a test, Humboldt County's electorate earned a solid "F" on Tuesday."
Then there is Senator Bernie Sanders on Democracy Now:
Senator Bernie Sanders says. "I fear that we may be on the verge of becoming an oligarchic form of society where a handful of billionaires control not just the economy, but the political life of this country. And that’s just something we’re going to have wrestle with."
Actual election turnout far lower than reported

And if you are really, really interested in a meaningless expression of an exercise in futility, go over to the local prognosticator's blog of all thing politic for a bellyful useless bullshit.

Where Is the OUTRAGE?

[UPDATE :: EIGHT DAYS NOW & STILL NOTHING!] 
What's the matter with the people in Eureka? Do you not see what you are doing to this community by cowing to this idea that the police have the right, no questions asked? What about the new District Attorney?

I was always proud to be born and raised in Eureka and Humboldt County - Now I'm just ashamed.


[UPDATE II : Thursday, September 25]
Another blasé statement from the Tuluwa Examiner surfaced this morning. Mostly a political whitewash of the boy's murder. Of interest, among other things, is their suggesting the "need" for a citizen's review board. No suggestion as to how to get one, though. No mention of any concerns for a criminal indictment or anything relevant from the District Attorney's office or why not. Still, worth a read. And don't forget to read the comments. They'll give you a hint why the people of Eureka are not outraged at the threat we are all subjected to if these killers are treated with impunity. It isn't just the wanton killing of the boy that is the crime. As bad as that is, it is the in-your-face threat we are all facing. When some scared shitless paranoid cop sticks a gun in your face the time for talking is over.

By the way, after posting the above Update, I read the North Coast Journal article: "Officer Involved - Inside EPD's Protocol" by Thadeus Greenson. Greenson's articles in the past, as observed here multiple times, were often contradictory and conflicting and always biased for the police. The Tuluwa posting is, either way, pretty much a knockoff of what the Journal said. This idea that these so-called community blogs keep pumping out that we need to be patient for justice is a betrayal of their trust. Justice demands transparency and urgent and timely truth-telling by everyone involved. In a Democracy, the people have legal right to know the truth. Anything else is a coverup and a whitewash. Enforce the law.


Here it is, four days after the Eureka Police shot and killed 22 year old Thomas McClain, and absolutely NOTHING!

Did Thomas McClain need to be black before anyone gets angry? Are black people the only ones in this country that have a decent heart? Are black people the only ones with any kind of moral clarity? Are black people the only ones with any kind of integrity, and love for the law?

I checked the Times-Standard newspaper and its Letter to the Editors, nothing but nominal bullshit. I checked the local blogs, starting with the wannabe community leader in all things moral and ethical in Eureka, the Tuluwaa Waa Crybaby. Their first blog was a total capitulation. Then today they posted this, MILLS: “THERE WAS A GUN RECOVERED. I DON’T WANT TO GET INTO WHERE……”(TILL WE GET OUR STORY STRAIGHT)

This is how they start the post:
On Wednesday, we urged readers to be cautious before jumping to conclusions regarding the young man who was shot to death by a Eureka Police Officer.  In trying to be fair and objective, we asked readers to wait for more facts before making judgements about the tragedy.  At that time, all we had was a press release which was very short on details.  The release basically stated that the police had been looking for warrant suspects in the area, saw two people arguing, one of which “appeared” to have a gun.  Officers supposedly gave commands, and the victim reached for the apparent gun and was shot to death by an officer.
"All they had was the police press release" which is to say all they had is the POLICE VERSION. This is how they end their article posted today, Saturday, September 20, 2012, four days since the incident:
The fact that a young man was gunned down by police while standing in his own front yard, and that there was no call for the police to be there is nothing less than completely heartbreaking.
While this article: MILLS: “THERE WAS A GUN RECOVERED. I DON’T WANT TO GET INTO WHERE……”(TILL WE GET OUR STORY STRAIGHT) raises some valid points and is well worth reading and our graciously linking it to our blog, there is not a hint of outrage. "Completely heartbreaking" they say? Do they know that considering the points they make that the people of Eureka CANNOT tolerate such a police department! These people are a cancer that physically threatens every living citizen in this town and every other person that comes here to visit.

One more point regarding the Tuluwat Examiner commentary:
The fact that Mills hasn’t disputed the claims about whether the victim was holding a cell phone or a gun is very telling about his leadership, which harkens back to the bad old days of EPD.
Very telling about his "leadership"? What it is telling about" is his capacity to tell the TRUTH. The "bad old days of EPD" has to do with mealy-mouthed, lying and thug bullying by Merl Harpham. That's what Andrew Mills is exposing.

Then there is the Lost Coast Outpost: The Death of Tommy McClain: What Happened in Wednesday's Officer-Involved Shooting by Kym Kemp - NOTHING! No outrage from her. Absolutely PATHETIC. From an informational point of view, well worth reading, though except for this:
A neighbor who wishes to remain anonymous disagreed. In an interview today the individual said, “I did see an object in his hand.” The individual did not want to describe the situation further except to say, “I feel that the level of force used was justified. It was a clear threat to the officer’s life. I feel it was unfortunate. But it was fortunate that no others were injured.”
This person is sick. First, the "anonymous" person's opinion is totally worthless and should NEVER be included as if it has some validity. Second "an object in a person's hand does NOT constitute a "clear threat to the officers (apparently four (4) officers) lives. That person's statement is totally ludicrous and demonstrates Kym Kemp's propensity as an avid apologist; a bigoted and biased supporter of all things police.

All other blogs, not even a mention. Check out the comments section of the different blogs and you won't find any outrage there either.

The lives of the people of Eureka, Kym Kemp lives on Salmon Creek Road in Southern Humboldt, hang on the good wishes of scared shitless paranoid police officer feelings of personal threat. As far as I am concerned every last one of them deserves what they get.

YOUR LIVES ARE IN MORTAL DANGER EVERY DAY AND YOU ARE WAY TO STUPID TO KNOW IT!

On 9/17/14 at 12:30am a precious life was taken due to a Eureka Police Officer making the wrong call. EPD needs to know they did wrong. RIP Tommy ♥
The emphasis is mine to point out the subtly of buying into the brainwashed propaganda that is a lie. Those officers did NOT make a "wrong call." They did not just do a "wrong," they committed a crime - they shot that boy down like a dog. He was dead no matter what he did. In their minds he was armed with a gun, a gun they say was only verified when they confronted him at the point of a gun and that's all they need to justify their violent confrontation. They made NO "wrong call." Such a confrontation could happen to anyone of us in this town. Time to accept the reality of our situation in this town. Then you can start talking about justice.

The Death Of Free Speech

Glenn Greenwald touches on a subject close to my heart: Free Speech Versus Community in his Guardian column for Sunday, October 14, 2012. It is reprinted here for the benefit of all would-be consumers.


1) In Sunday's Washington Post, law professor Jonathan Turley has a superb Op-Ed on the gradual death of free speech in the west, and he places the blame squarely where it belongs: on the veneration of "sensitivities" over the free flow of ideas, and relatedly, the adolescent need on the part of many adults to plead with authority figures to shield them from views they find offensive. His essay is well worth reading in full, but here is the crux:
"Free speech is dying in the western world. While most people still enjoy considerable freedom of expression, this right, once a near-absolute, has become less defined and less dependable for those espousing controversial social, political or religious views. The decline of free speech has come not from any single blow but rather from thousands of paper cuts of well-intentioned exceptions designed to maintain social harmony. . . .
"Of course, free speech is often precisely about pissing off other people – challenging social taboos or political values. . . . 
"Such efforts focus not on the right to speak but on the possible reaction to speech – a fundamental change in the treatment of free speech in the West. The much-misconstrued statement of Justice Oliver Wendell Holmes that free speech does not give you the right to shout fire in a crowded theater is now being used to curtail speech that might provoke a violence-prone minority. Our entire society is being treated as a crowded theater, and talking about whole subjects is now akin to shouting 'fire!' . . . . 
"The very right that laid the foundation for western civilization is increasingly viewed as a nuisance, if not a threat. Whether speech is deemed inflammatory or hateful or discriminatory or simply false, society is denying speech rights in the name of tolerance, enforcing mutual respect through categorical censorship. 
"As in a troubled marriage, the west seems to be falling out of love with free speech. Unable to divorce ourselves from this defining right, we take refuge instead in an awkward and forced silence."
I'm accused with some frequency of focusing my critiques on the US - the reason I do so is set forth here in reasoning I adopt in full - but vibrant free speech protection is a core liberty which the US, though very far from perfect, still safeguards better than most countries.

What has always driven repression of speech are the same universal human traits that are now flourishing as part of this latest effort: the tyrannical thirst for the power to silence ideas one dislikes, the self-regarding belief that one can apply objective principles of decency, "community" and Goodness to decide which modes of expression and which ideas should be barred, authoritarian trust in leaders, and – worst of all – the refusal to understand that endorsing repression of ideas leaves one with no principled grounds to object when one's own ideas end up on the prohibited list.

Throughout history, it has often been the case that today's "hate speech" becomes tomorrow's enlightenment. Today's "incitement" becomes tomorrow's righteous subversion of unjust authority and flawed orthodoxies. Add to all that the ignoble tendency to object to - or even recognize the existence of - repression only when it affects one directly (a dynamic I described here when writing about the inability of many passive, obedient western citizens to acknowledge the repression of their own governments because such citizens are never the ones targeted for repression), and it's clear that the opposition to free expression is grounded in the worst of human attributes.

In sum, it takes a staggering amount of hubris to believe you're in any position to decide which ideas are so objectively and permanently wrong that they should be barred. It takes an equally staggering amount of childishness to want some central authority to protect you from ideas that you find upsetting. And it takes extreme historical ignorance not to realize that endorsing the maintenance of a list of prohibited ideas and then empowering authorities to enforce it will inevitably lead to abusive applications of that power and, sooner or later, will likely result in the suppression of your own ideas as well. [Emphasis added]

I reprinted this article because we find the same disease festering in this community (Humboldt County) among local bloggers and newspapers. Those that are out front always beating their chests about promoting and defending free speech are the first to censure over unknown reasons.

Security State Tightens the Noose Again

Bill toughens vaccine opt out option - Proposed law could make obtaining immunization exemptions harder for parents

Headline in the Thursday, September 13, 2012, newspaper.

VACCINATIONS: 'Most vaccines are not 100 percent effective'.

Vaccination are supposed to immunize a child entering kindergarten from communicable diseases. That means the child is protected from the diseases that might come from some child that did not get vaccinated.  Does that make sense? You would think so.

So, how do you justify this statement by Susan Buckley, Humboldt County Department of Health and Human Services' Public Health Director:
"Exemptions contribute to low vaccination rates, which put all students at risk." [Emphasis added]
That would mean getting vaccinated is a waste of time and money if you're still "at risk."

Melinda Whareton, deputy director of the National Center for Immunization and Respiratory Diseases at the Centers for Disease Control make the most inane and asinine argument for why EVERYONE must be vaccinated:
"Most vaccines are not 100 percent effective. People can still become infected, even if they have been vaccinated, if they are around someone who is not immunized and has the disease."
That's a clear cut argument for NOT getting vaccinated if I ever heard one.

This is the typical moronic thinking that a "father knows best" form of government uses to brainwash people into submission. Vaccinations typically make you a little sick, so as to build your resistance to getting  really sick. Nothing like filling your body full of crap that makes you sick so that you don't make someone else sick. When I was in school they used to tell us that a hitch in the Army would make us men. That is if you didn't get killed in the process. And a lot of us did too.

Yeah! Good thing for the "herd." Good thing for parents alright. What's next, artificial insemination?

Twice Screwed


When I read “'Shaded' parcel owners, staff meet” in today's Times-Standard, once again I had confirmation as to why the wife and I were not going to invest in rural Humboldt County property. Another good reason is the California Fire Tax, but that's another article. Here is a classic situation where the innocent victim is made to pay for the crimes of another. These people, through no fault of their own, having over a period of years in most cases possess a large investment in time, health and treasure are, well after-the-fact, faced with the state's legal threat putting it all in jeopardy. Rather than try to protect these people's investments, they try to force them to do what the County Planning Department failed to do over an extended period of time. And then, on top of that, make them pay for it. You know what they are trying to do is wrong when they do everything behind closed doors. This is a classic shake-down – legal extortion.

It was when I read this portion of the article that I remembered back to the untold number of times over the years that I heard the same kind of talk from a lawyer that I had just paid a small fortune to represent my best interests:
 “Local attorney Eric Kirk is representing about one-third of the Seely Creek property owners. He said the next step for many of his clients is to file for a conditional certificate of compliance with the county. The certificate would outline the improvements required to make each plot legal, such as bringing sewer systems up to code. 
Kirk said the certificate could cost his clients anywhere from $300 to $1,700, depending on whether new parcel maps or surveyors have to be utilized. In the meantime, he said his clients will be looking for documentation, such as building permits, titles and deeds to prove their lots are legal. 
Kirk said it appears the county wants to resolve the parcel problem in a way that is as painless as possible
”I'm getting that once they have the conditional certificate of compliance, they've done their due diligence in the state,” he said.” 
Does that sound anything like this property owner?
Seely Creek property owner Georje Holper said she's frustrated with how the county is handling the issue. 
”To put the burden on us is not right,” Holper said. 
As a group, the property owners said it's the county's responsibility to determine the legality of the parcels -- especially since they didn't know the parcels were illegal when they were purchased. They said the county doesn't have any records of when the parcels were shaded or by whom, so the burden of proof is on the county. 
 Compare what Eric Kirk says to this:

Humboldt Coalition for Property Rights Chairman Lee Ulansey said he knows for a fact that some of the properties were shaded by people who simply took a pencil to the antiquated maps. He said the maps aren't kept under lock and key, so access to the records isn't monitored. 
Ulansey said the county has gone about the shaded parcel issue the wrong way, pushing Hum CPR -- a private property rights organization -- to file a lawsuit against the county in April. He said the county needed to do more research on each parcel before simply declaring them all illegal. 
”They need to get to that solution before they disrupt people's lives,” Ulansey said. [Emphasis added]
 So, with a stroke of a pen, all these people own "illegal" property. And Eric Kirk says the best thing for all of these people is to "file for a conditional certificate of compliance with the county." In other words, these inadvertent "illegal" property owners need to take personal legal responsibility for purchasing and owning their "illegal property". That way the County can walk away free and clear. Never a thought about making the County be accountable for their negligent irresponsible acts. Just make the people with everything to lose, pay and pay.

"Painless as possible" - Yeah! Right. TWICE SCREWED.

Supervisor's Set Priorities – for the Vote that Counts


Was that the vote at the ballot box the 1,450 caregivers made when they voted for the current crop of County Supervisors? Or was it the vote some of the more wealthy property owners made with their dollar election support?

What strikes you when reading the front page of the Wednesday, July 11, 2012, Times-Standard newspaper? Aside from the fact that Shell's WindEnergy program isn't bringing any future business or jobs to Humboldt County or any tax dollars either are the two other headlines. First one is, Humboldt insists no wage increase forhome care workers and Supervisors approve adding moreWilliamson Act properties.

This is what the paper says about Home-Care workers:
“Negotiators for the county's In-Home Supportive Services workers -- who help aged, blind and disabled individuals remain in their own homes -- have been petitioning the county for increased wages. Care workers currently make minimum wage -- set at $8 an hour -- and don't receive any benefits.”
And this is what it says about the benefits for private landowners:
“The board voted 5-0 to accept new applications this year, allowing the county to enter into contracts with private landowners as a way to restrict land use to agricultural or preservation purposes. Participating landowners receive lower property tax assessments.”
County Supervisor priority speaks loud and clear. The picture caption of the Bulldog on the same page probably says it all about what your vote gets you – Whatta dog!

Self-Defense Is a Bitch

Cops don't kill anyone anymore in Humboldt County, they just leave them dead on the street.

Once again, the local newspaper, the Times-Standard soft-pedals the killing by police of another mentally disturbed person. See the front-page Saturday, March 17, 2012, story title: Officer involved shooting leaves Fortuna man dead – REALLY?

Makes it sound like there was some sort of gun battle going on with an officer, or some police officer just happened to be around somewhere when a Fortuna man was found dead. Evestigate the newspaper a little more and you will find that and unknown “26-year-old” was "shot" and “killed.” Why? We quote the newspaper: “[A]s he allegedly attempted to strike officer with a baton” he had taken away from one of the MORE than one officer. Who, apparently, had used all their little toys, to no avail, so they just shot him dead.

In truth, what we simply have here is that, a police officer shot dead a Fortuna man. The bullets that killed the man didn't come out of the blue and somehow “left” the poor guy “dead.” It came from a specific person, a Fortuna police officer. The simple fact is, that an unnamed Fortuna police officer killed that man. NOT some bogus nonsense, "Officer involved shooting leaves Fortuna man dead."

Once again, just like the newspaper's title is misleading, so is their report of the incident. The headline says the dead guy “attempted to strike officer with baton.” So does the reported police news release.
A second officer arrived and joined in the effort to subdue Newmaker in a struggle that became increasingly violent, according to the release, culminating with Mewmaker's allegedly wrestling a baton from one of the officers.
"As the suspect was in the process of attempting to strike the officer with the baton, the other officer fired his weapon at the suspect to stop the atack on his fellow officer," the release states."
Thadeus Greenson, the writer of this news report adds his slant, as tries to justify another police slaying: “Ultimately, an officer fatally shot Newmaker after he took one of the officers' batons and began striking him with it.” This Report has found this kind of biased newspaper reporting from Thadeus Greenson, in particular, to be status quo – NORMAL.

Please note here, the police news release says "As the suspect was in the process of attempting to strike ..." - this is about as remote and ambiguous a NON-THREATENING action as anyone could be involved in that certainly does not pose an eminent threat to anyone's life. "In the process of attempting"? This is total NONSENSE.

The absolute question that begs an answer is, how can “attempting to strike an officer with his, [a police] baton” justify the use of deadly force? Do the police NOT strike, or threaten to strike, people all the time JUST to avoid the use of or the need for or use deadly force? Isn't that why they pack batons?

People need to take a real serious look at what the Fortuna police have done here. When peaceful demonstrators legally exercise their citizen rights and are regularly set upon by the baton-wielding police beating them into submission they are threatening the very lives of these legal, and peaceful demonstrators. Clearly, if the police are justified in this killing under these conditions and stipulated circumstances, then people guilty of NO crime when their lives are threatened by a baton possess the legal right to defend themselves and with lethal force if necessary against any and all criminal assaults. The police in this country and in particular Humboldt County that take great delight brutalizing people, in particular the Occupy Movement people might want to pay close attention to what they are establishing.

Brutality Versus Terrorism


Time for the Occupy Movement to wake up to reality.

The question, until now remained unanswered: Why did city governments and their police officers respond so violently and with so much brutality against peaceful people threatening no one, simply asking for a little consideration?

Today, at least for Eureka, California, we got a partial answer – PARANOIA.

The Times-Standard reveals in their County emails outragemembers of Occupy Eurekathe existence of “nefarious” “emails” “that led to police action against the Occupy Eureka encampment on the Humboldt County Courthouse lawn.” Why? Read the condemnatory words of the leading police official and law enforcement officer, District Attorney Paul Gallegos:
“While I do not suspect that any of those tents contain any explosives or otherwise dangerous materials, I cannot confirm that they do or do not and I do not believe that we can allow the risk of such an occurrence to continue.” [Emphasis added] 
No fact-based reality contained in anything Gallegos says, only his paranoid, fantasy-based vilifying accusations of “terrorism” that demonstrates his true attitude regarding the people of the Occupy Movement – inept, incompetent, gullible, and stupid terrorist.

Grant Scott-Goforth of the Times-Standard puts it this way: “Gallegos said he worried it was possible for people not directly associated with Occupy Eureka to guise the group as cover for illegal activity.”
The hypocrisy of Gallegos is mind-blowing, if nothing else. He says: “Candidly I support the movement. Unfortunately here it has been somewhat co-opted locally by our local protesters.”

In what way? What could these local protesters possibly want the the movement doesn't want when dealing with the dregs of society; homeless people and a “leaderless nature” that obviously couldn't know what it wants other than issue “hyperbole.” Notice how unreasonable these “Occupy People” are according to Gallegos and why he refuses to recognize and engage them: “If people want to sit down reasonably, they're going to find complete cooperation.” Then immediately contradicts that propagandist assertion by saying: “Occupy Eureka doesn't have a monopoly on concerns about the county and the community.” Why? Because in his mind they do not represent the 99% of Americans. He and his supporters do. That's why he and his police deal with them for the “terrorists” that they really are.

A good lesson on what “terrorism” and what makes “terrorist” – how the wanton accusatory use of the word automatically vilifies, condemns and justifies the extreme forms of sanctioned brutality and criminal conduct – is explained and defined by Glenn Greenwald in his Salon.com article, Iranand the Terrorism game” - to quote from his:

UPDATE: There’s one point that should be added about why this matters so much: the fact that Terrorism has no fixed meaning does not mean it is inconsequential. The opposite is true. Terrorism is one of the most consequential words in our political lexicon. The term designates Supreme, Unmitigated Evil. Once someone is successfully branded a Terrorist, it means that anything and everything can and should be done to them without constraints.

And concludes with:
As I’ve said before, Terrorism is simultaneously the term that means nothing and justifies everything. That’s why such strong emotions are evoked when it is used in a way that deviates from mandated orthodoxies. It’s a meaningless term, but incredibly (perhaps incomparably) significant in governing how power and violence can be wielded and against whom.
So now you know why Gallegos painted the local Occupy People and their “peaceful protests” as “terrorist” - stupid people that believe they have some God-given or Constitutional right to be recognized for who and what they “think” or “believe” they are. He wants to be, as he claims here, to be the man of the people, but he's co-opted by his own attitude, actions and hypocrisy as defined and established by the Occupy Eureka people.

Whether or not it was the newspaper Editor or their writer's intention or not, they did expose the truth about Paul Gallegos' hypocrisy. The issue, as applied to these people peacefully protesting, went far beyond simply “taking down a few tents” to branding the local people as potential terrorists and their protest actions as terrorism. It went to the very heart of why the local so-called representative government went so far to renounce and denounce the legitimacy of a courageous people willing to Occupy their rightful space on this Earth equal to all others.

The citizens of Humboldt County and particularly Eureka are quite capable of deciding for themselves what is and what is not “public safety.” Despite the arrogance of the one percent, we're not a bunch of dogs that need to be told when to “sit” and when and how to “speak.”

Humboldt Shame

[UPDATE]
When I picked up my Wednesday, November 23, 2011, Times-Standard paper today and the this picture pasted on the front-page, Use of pepper spray at Davis brings back memories of '97 Palco protest; university president launches investigation and read the caption where they used the word, "allege,"  I was instantly enraged – AGAIN!

Allege means to "assert without proof." Then writes, "Eventually, officers swabbed pepper spray on the protesters' eyes in order to remove them." The fact is, they didn't need to "swab" anything in their eyes to "remove them." They used pepper spray just like they us the Taser to force submission and forced yielding - coercive rape at it's essence. The paper, regardless the writer, in this case Dona Tam, never gives-up on the biased propaganda justifying the crimes.

I was out of this area when that incident took place. When people found out that I was from Humboldt County they wanted to know what kind of neanderthal barbarians Humboldt County people had on their police forces? The only conclusion anyone could accept is that these people were not only sick, but sadistically sick.

We're not talking about just the Sheriff and Police Chief and their officers, but the whole damned community. The sickness that permeates this community was quite well defined when the justification for what amounts to a form of sadistic rape legally declared acceptable. What did the people in this community do about the District Attorney, the Sheriff, the Eureka Police Chief and the officers involved? The consequences of those acts that day are clear in the pictures of how the police deal with peaceful people all over the world. No father of any worthwhile value, including one of the girl's father, Jan Lundberg, would ever tolerate their daughter's treatment recorded here for the whole world to see. When you look to the criminal for justice, and get injustice, you are as guilty of the crimes committed as they are.

Shotgun pellets or pepper spray, what's the difference?
When you read articles like this one: Torture’s Future, By ERIC LEWIS in the New York Times and this one by Glenn Greenwald: The roots of the UC-Davis pepper-spraying along with pictures like this of what the heroic police and courageous solders are doing to their neighbors it all kind of jumbles together as something that doesn't involve YOU. Problem is, when you pickup your local newspaper and see similar pictures that happened right in your own hometown and know there is a twenty year legacy of such acts of vile hatred and sadistic barbarity, you've got to face the facts – like it or not.

When Eureka Police Chief Murl Harpham tells the homeowners and business people in Eureka that he has “tough” cops at their beck and call. These are the kind of “tough” people he's talking about. Notice in the accompanying article: Police pay third visit to Occupy Eureka at courthouse – Notice this statement: [O]one woman was arrested Tuesday morning after she allegedly became aggressive with a county employee, Harpham said.” “Became aggressive” in what way justifies an arrest? Raise their voice in objection? And the county employee didn't precipitate the incident with aggressive conduct? That “county employee” kept their business to themselves, just walked quietly by and never said a word or made a filthy gesture? Eureka police officers are, when they want to be, are extremely thin-skinned. Simply asking them a question can be cause for aggressiveness in their minds. Consequently, everyone walks a tightrope when dealing with the police.

These words by Swellsman are worth repeating:
And, yeah . . . the rest of us might want to think about trying to undo some of the power and public relations imbalance that we have allowed to creep into law enforcement’s favor by our past apathy in the face of public abuses. 
Despite what they’ll tell you, and what we’ve been conditioned to believe, the cops are not the law. The law resides in a system, not in a person, not even in a group of people. Cops are merely citizens – just like you and me – who have been given special dispensation to arrest people under certain circumstances and then turn them over to that system . . . and nothing more. 
And it seems to me that America would be a lot better off trying to keep that basic fact in mind.

The elites of Southern Humboldt try to put on a pretty face for everyone to see believing that they are inoculated from the disease. Why "synonymous"? Because it tells you something about the character of Garberville. Not the character today, but when that sign first proclaimed "WELCOME! The friendly folks are here to serve you good stuff." The welcoming and accepting hand was out for everyone. You could go into Garberville and be served in your dirty, dusty logging duds right alongside a family in their Sunday best that just came from church.  I know, I did both. It didn't matter who you were, you all got the same - the best they had to offer.

If there is one thing the "Occupy" people are demonstrating, is that all politicians are bought and paid for whores. The question everyone needs to ask is, who is the worst one? The Pimps that pay off these corrupt prostitutes or their willing patrons? In Southern Humboldt it doesn't take long to figure out who the Pimps are.

There is a simple truth in the World, a truth wannabe Elitist never seem to understand: People must live - Life lives one way or another. Take away all the jobs, kick people out of their homes, what are they going to do? Just blow away or die? People like Eric Kirk and Ernie Branscomb that suck off this Capitalist Whore want all the benefits of the deprivation they cause and exploit, but no part of the responsibility for what they've had a part in causing.

There's another Universal Truth most people never ever seem to learn, that is, until it's way too late: "You shall always reap what you sow" - For the Kirks and the Branscombs of this world that means: "What goes around ALWAYS comes around."

I guess it never occurs to these people that a good product - good reporting, accurate, truthful and timely news reports is the time-honored way of producing revenues, both for them, their readers and advertisers. A naked police press release without relevant followup is as skewed and basically irrelevant as it gets. We don't need some corporate master telling us what is and is not. Show some respect for your readers with simple facts that backup the truth where people can decide for themselves. Followup on important stories. People want to know what happens when it takes a year to investigate BEFORE any comment or resolution. We've got plenty of mainstream media nonsense without involving the local media too.
